Tackling the Minefield of Legal Research

Tackling the Minefield of Legal Research Tackling the Minefield of Legal Research Tackling the Minefield of Legal Research Legal research is complex in nature because the student has to deal with primary and secondary legislation, case law, circulars, bills, parliamentary debates, whitepapers, Law Commission research and recommendations, treaties and international law (just to name a few). These sources are significantly different to secondary source research. This is because the student is no longer examining a source in isolation and analyzing it in the context of theoretical principles taught in the classroom. Instead, the student has to examine legislation and use case law, parliamentary debates, circulars and other resources to apply it. However, this does not prevent theory playing a role, because the courts will consult with theory and leading academics to apply the law. Additionally, the courts will consider international legal principles when appropriate. Thus, the student has to be able to maneuver in the minefield of legal research to come to a conclusion. An added problem is that the law is not black and white (except in the case of strict liability legislation!). This means that there is not a “right” or “wrong” answer; rather the student has to learn to deploy legal tests that are set in legislation or the standard “reasonable person” test. The result of this is that the student has to learn how to collate the appropriate legal principles, legislation and case law to come to a conclusion. However, this is not the end of it, because the student then must apply and analyze their legal conclusion in a manner that would be acceptable in the courts. The student undertaking legal research is bombarded with Latin terms, such as mens rea, actus reus, pacta sunt servanda, prima facie, de jure, caveat emptor, de minimis and res ipsa loquitur. These are just a few of a legal dictionary full of Latin terms, which means that the student is not only faced with the complex and unique nature of legal research but also has to tackle many foreign terms. The final and arguably the most daunting element of legal research is that textbooks may not be reflective of the most recent developments, because a decision in the courts or a parliamentary statement can affect the interpretation of a legislative or legal principle. Thus, the student has to learn how to continually update the law, which may not be reflected in the textbook. It is also paramount for the student to understand that the court’s decision may be distinguished from traditional legal precedent or it may overturn this precedent. All of these elements illustrate that legal research is truly a minefield. Many students approach the law under the mistaken belief that the law is black and white when in fact it mainly operates in the grey areas. The ultimate aim of any course in law is to provide the student with the tools to tackle this legal minefield. Here at Homework Help USA we can help you tackle this minefield by providing custom essays, legal advice letters, problem question answers, dissertations, contract exemplars, and one-on-one tutoring through Skype or email. The Descent Of Mount Ventoux Analysis - 1469 Words

Petrarca’s Ascent of Mount Ventoux gives the reader a deeper understanding of what the image of human thought and psychology was during the time. The writing gives insight into concepts critical to the Renaissance such as awakening, search for self, humanism, meaning of happiness and secularism. Additionally, it tries to understand an individual’s position and duty in the world. The development of inner thought in the writing is unique because it was not present in earlier texts, meaning that there is greater importance being placed on oneself and that one’s thoughts are just as valid and carry just as much weight as the teachings of God. Petrarch cites classical and Early Christian texts as a source to explain his own life†¦show more content†¦He also notes that he read Roman history in which King Philip, who waged war against the Roman people, ascended Mount Haemus in Thessaly, where he claimed that he could see both the Adriatic and Black sea from the summit. Petrarch’s mention that he wants to follow in their footsteps show that he draws no distinction between aristocrat and himself and that he views himself as equal. Petrarch places himself in the shoes of historically significant individuals and tries to relive their experiences. At the top of the mountain, Petrarch has a sudden sense of remorse; he cites to himself how â€Å"This day marks the completion of the tenth year since you gave up the studies of your boyhood and left Bologna†¦How many and how great were the changes you have had to undergo in your moral habits since then†, Petrarch expresses a sense of nostalgia and self-disgust for living a materialistic lifestyle. He is upset that his studies have not adequately prepared him for leading a meaningful life and that he now has nothing to show for his hard work. It is noted that on his way down he did not say a word, which represents the uncorrupted/ pure human thought. His frequent citation of classical literature throughout the text shows how much antiquity was admired during the Renaissance. Once Petrarch reaches the top he reads the Augustine’s Confessions from which he reads â€Å"And men go to admire the high mountains, the vast floods of the sea, the huge streams of the rivers, the circumference

Introduction The 19th century developments of firstly the telegraph, and later the telephone, opened a gateway to a new, closer, more interdependent world. For a country as large as the United States, with a population now scattered from east to west, the implications were tremendous. The infamous tyranny of time and distance had been conquered. Widespread acceptance and appreciation, however, were not immediate. Both inventions met with initial scepticism, ridicule, and even elements of fear. The wisdom of twenty-first century hindsight makes such reticence seem incredible and somewhat amusing, but the very magnitude of instantaneous communication was the source of anxiety in the first recipients as much as of excitement. His studies at Yale refined his primary passion for art, but Morse was also fascinated by the sciences, particularly the new theories of electricity. The studies he enjoyed at this time fostered his continued interest and attention to developments in the field, and were to form the basis of his discoveries decades later. For despite the concentrated efforts of others from the 1820s to create an electromagnetic telegraph, Morse did not appear to have been aware of these developments and he worked, in the main, independently. Throughout Morses financially insecure career as an artist, his studies, both in America and Europe led him into contact with other men of scientific interests. In 1827 Morses role as founder and president of the National Academy of the Arts and Design in New York provided opportunity to attend lectures on electricity and electromagnetism by James Freeman Dana. A friendship developed based on their mutual interest which furthered Morses knowledge in the area. Years later, Morse was to have a critical chance encounter with a fellow passenger on a steam packet returning to America from a European trip. What Is Your Opinion About Marriage free essay sample

Marriage is defined as a social union or legal contract between people called spouses that create kinship. The definition of marriage varies according to different cultures, but is usually an institution in which interpersonal relationships, usually intimate and sexual, are acknowledged. Such a union is often formalized via a wedding ceremony. People marry for many reasons, including legal, social, being in love, libidinal, emotional, financial, spiritual, and religious. Marriages can be performed in a secular civil ceremony or in a religious setting. The act of marriage usually creates normative or legal obligations between the individuals involved. I personally think that marriage should be formed on the foundation of love. Other factors can be considered while finding a potential partner for marriage but love should always be the first criteria. This is because without love, I think that the couples will have a hard time tolerating with each other at the beginning of a marriage and quarrels would be very frequent. We will write a custom essay sample on What Is Your Opinion About Marriage or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page But with love, at least it will be more easier for each parties to tolerate due to the special bond shared between them. Moreover, love enable the couples to have happy moment with each other throughout the marriage. Compared to couples that just do not have the chemistry attraction between them, most couples with love will have a more wonderful life together. Moreover, I think that marriage should be conducted out of own willingness and not due to parents forcing. This is because, if one just marry for the sake of having a child for their next generation, then there are higher possibility for one partner in the marriage to neglect their spouse as they may think that their spouse are like birth tool and nothing else. For them, their spouse are not their soul mate and they may not share their struggle, pain, joy and everything else with their spouse. This will cause their spouse to feel neglected and unloved. Worst still, these types of couples may end up divorcing or sorting to domestic violence. For these kind of marriage, usually their child will not be brought up in a loving environment and may grow close to either the mother and hate the father or vice versa. These marriage will also affect the emotional and mental development of the child. As the child grew older, they may think that love is not important and so are less understanding and loving towards other people. They may grow up to be a very selfish and greedy individual. Furthemore, marriage should also take into consideration financial capabilities of both spouses. As we all know, to even conduct a wedding ceremony, one need a huge amount of money, from the wedding dress, wedding ring and to the wedding dinner, all require careful planning and huge amount of investment. Marriage do not just stop at wedding ceremony, it also proceeds to the basic needs of starting a family like preparing a house, a car, money for the children education and so on, hence, I think that before a couple think of marriage, they should have a permanent job with a stable income. If a couple do not have enough financial capabilities, the marriage are definitely going to be doomed sooner or later. Just think of it, if your parents do not know how to manage their finance well, do you think that you will have a stable and peaceful life like today? Instead, there will always be quarrels among couples that blame their spouse for not being â€Å"useful† enough to find a stable job with good income. You will find sentence like â€Å" we need to pay for electrical and water bill soon, but we do not have enough funds, why aren’t you providing enough for all of these!? † in the life after marriage of couples that are not well finance. Hence, though it may sound very realistic, but a part of marriage includes financial capabilities of both spouses. Besides, I think that marriage should not be only for couples that wanted to have baby. If the lady is infertile, I think that she still deserves to be wed to the guy that she loves. Marriage is about the union of two souls and body that are so in love and not a tool to provides baby only. I think that family members of either side should not stop their children to step into wedding ceremony just because their partner is infertile or if the guy body condition do not allow him to produce baby. Though many may think that offspring is the ultimate reason for marriage, I totally disagree with that. I personally think that offspring is one of the important reason for marriage but not ultimate reason for marriage. Marriage holds a much more significant meaning than just that. Moreover, with technology advancement now, if one of the spouse not able to produce baby in a natural way, they can always try in- vitro way. If their condition really cannot, then there is always adoption as an option for them to start their family. Though there are lots of argument that states that if a baby is adopt, the child do not have the same bloodline and are not the â€Å"true† family members and so may not be that trustworthy. But let me remind all of you a child is shaped mostly by their environment. Though I know that omehow genetic play a role in a child personality, but that is only minority. If the child is brought up with good moral values, there is no doubt that the child most probably will be a fantastic person in the future. Though there are a few types of marriage like gay marriage, lesbian marriage and different sex marriage, but I must admit that I can only accept different sex marriage. The reason for me to say so is that I believe same sex marriage is against the nature. If you observe nature properly, you will realise that a male and a female regardless whether it is human or animal, is meant to be together. Male and female each represent a half of the other. When both male and female married, both flesh are joined together and become one. When this happen, they will be able to produce offspring. The fact that a guy can only produce his own baby by having sex with a girl shows that nature also have it that a guy are meant for a girl, and a girl for a guy. This is why even if guy have sex with guy, they cannot produce their own baby, this is because the very structure of their body are in nature the same and they are not the half of each other like I mention above how girls are like the other half being of guys. When both half beings join together, then they can only be one and can only have baby. Though I understand that there are many arguments that some guy just cannot like girls, if that is the case, then I prefer these guys to just stay the way they are and do not pursue marriage so as to prevent more social problem. Though I cannot accept same sex marriage, but I can accept different race and ethnicity marriage. Though there are many cultural differences among couples of different races but I believe that they will be able to overcome it as long as there is love and understanding among them. Traditions can always be learned and practised as long as someone has the heart to do so. So, I think that different race marriage should not be a problem for couples that thinking of marriage. Another reason why I approve of different race marriage are this will allow exchange of cultural practices among two communities. In this way, a community can be able to be more understanding towards another community of people and learn to respect them as well. Since there is barely any negative effects on different race marriage, I think that there is no reason for me to oppose it. I had even seen couples of different race construct a more happy family than those of the same race, there are also some sayings that said that if a guy or girl from different cultural background willing to married to his or her mate, this means that they love their mate very much and willing to learn their partners culture. In addition, I think that marriage should only be conducted when both partners feel that they are ready to be committed but not through the forcing of another partner. This is because, if a partner forces another into marriage, then that person may not be emotionally and mentally prepared. As a result, social problem like having affairs with another guy or woman may occur. This is because they may feel very burdened by their spouse so they seek to find another suitable mate that claims to be able to understand their feelings more and are being more loving to them compared to their husband or wife. Another problem about forced marriage are one of the partner may be very irresponsible in their action. For example, one of the partner may neglect his or her spouse by giving career busyness as an excuse and frequently come back late which cause their spouse to feel very neglected or lonely. If they have a child, the irresponsible partner may even throw the job of caring after the child to another partner and use â€Å"this is what u want and I am just giving it to you† as an excuse to not play a role in nurturing the child. As their marriage period proceeds, divorce may occur. Hence, though even if you feel that you are ready to settle down, do not rush your boyfriend or girlfriend into doing so. Give them sufficient time to mature and achieve their goals until they feel they are ready to carry this burden with you. If you rush them, you are most probably doomed to having a bad marriage. I think that in a marriage, there should be trust and respect between spouses. There should not be a party that feels he or she is more inferior compared to their partner. If one of them feels inferior, then it is most likely that they are being stepped on top by the other and lose control into making decision for the family. This is bad in a way that the party that feels inferior may sow bitterness and hatred towards his or her partner. With bitterness and hatred all around, you can picture that this will not be a happy family. Instead, there will be continuous quarrel in the family due to one of the party trying his or her best to keep their ego. So, it is very important for both partners to be able to respect each other. Moreover, if one party do not pay enough respect to his or her partner, if they have a child, there are very high chances for the child to either hate his father who bullies his mother or look down on his mother thinking that his mother is weak and easy to step on or vice versa. Either way, it is not good for the emotional and mental development of the child. If the child learn to hates such a young age, there is very high possibility for that child to be very uncaring and unloving towards others. However, if the child learn to look down on his father or mother, then there is very high chances for this child to disrespect elder that he thinks to be weak or soft in personality for him. Hatred and lack of respect for elder is a very common issues nowadays among our youngster. Hence, it is very important to provide our kids with the correct environment by first being correct in our interaction with our spouse. There should always be equality in both parents in a family. Neither one should be step down upon by the other. But both learn to cultivate trust and respect with each other. Though there maybe one partner that is more dominating while the other more submissive in a relationship, the more dominating one should always remember to ask the more submissive one about his or her opinion regarding family issues and not try to solve it by his or her own by providing solutions based on one judgement. By doing so, the dominating partner will be able to keep the other ego or pride in front of their child and the other also will feel that he or she is trust and respected by the other person. In a marriage, I think that responsibility of taking care of the house should be discussed and distributed equally. There is no such thing as guys only need to care about the career while woman care about the rest. We are now livings in a modern era, no longer at the era whereby girls are uneducated and just need to take care of house chores and appearance. Now, girls are very educated and career minded also. Suppose in a marriage, the wife has her own career to look after of, if she alone needs to manage all the house chores, would not it be very burdensome to her? In my opinion, guys should be more understanding and learn to help their wife to manage the house. It is no longer guys only that is the one providing income to the family, girls are also doing so. Hence, it will only be fair if the house chores are distributed equally among them. Not only house chores, if they have a child, the responsibility of caring and nurturing the child should not be the wife job only, it should be both the wife and husband job. If one party neglect the child, then the child may grow up emotionally incomplete as he do not receive love from his other parent. This is bad as the child may feel lonely or envy of other child that are loved by both parents. Therefore, in order to prevent all of this, the married couple needs to cooperate with each other to give their child the best care, moral upbringing and education to the child. What I mention above are solely my own personal view about marriage only. Every people have their own special view. For instance, some people may think that same sex marriage is acceptable while the other may think that different race marriage is unacceptable. It all depends on the individual own idea and thoughts. However, one thing was for sure. Marriage is a very important and honourable event and must be treated seriously by all.

Jane and Sam Larkin PO Box 1023 Everett, WA 98201-1023 Dear Jane and Sam, Thank you for taking the time to meet with a representative from Watson Custom Homes. Based on the information he shared with me, I think our business would be a perfect fit for your needs. We’ve been building custom homes in Snohomish County since 1996, receiving multiple awards. The quality of our work is well-known. We don’t just build homes, we build dreams. And that’s our goal for you if you choose to work with us. We understand that you have already done your site evaluations and are on your way to obtaining a building permit for your property. We would like to point out that permit requirements are stringent in Snohomish County, and we would like to help coordinate with you so that you can obtain the necessary permits without delays. Based on the copy of the blueprints you provided, I have drawn up some documents for you, including a preliminary cost summary, a statement of the work we intend to perform if you hire us, and a timeline. Please do be aware, however, that building materials prices fluctuate rapidly and often, so we cannot guarantee final costs until the materials are purchased. Also, in consideration of the fact that you would like to use top-grade materials throughout the home, the initial building cost estimate comes in at $256. 00 per square foot, which is higher than the average Snohomish County price per square foot of $192. 0, but reflects the quality you have chosen. Please be wary of any estimates that come in at this average price or lower; it simply means that the builders will be using lesser-grade materials or taking shortcuts. On a final note, we will provide you with a contracted price after final materials are chosen and before the construction work begins. We believe you should get in to your home on budget and on time, and we will not surprise you with hidden labor charges. Once we sign the contract, the price we have set is what you will pay, making it easier for you to obtain the proper financing. Of course, if you would like to make changes beyond that point, we are happy to provide a â€Å"change order† which may slightly alter the final price of the home. Please do not hesitate to call with any questions you might have, either about our services or about the building process. We would love to help you build your dream home. How to Write an Online College Admissions Essay

How to Write an Online College Admissions Essay Since most online colleges do not require face-to-face interviews, the admissions essay is the primary way administrators get to know applicants. You won’t be able to charm an interviewer with your witty banter or your knowledge of school history. Instead, you’ll need to make sure your personality shines through in your writing. How to Write YourAdmissions Essay that Wows Your Audience Analyze the question. Admissions officers are looking for something; you need to figure out what it is. Think of the admissions essay question as a puzzle waiting to be solved. Don’t take it for its face value – think a little deeper. A question such as â€Å"Who is your hero?† is probably a way for admissions officers to find out what the applicant values. If you say your hero is style icon Paris Hilton, you’d better be applying to a fashion school.Follow the instructions. Once you’ve figured out what the admissions officers are looking for, it’s time to write. Follow the instructions with exacting accuracy, even if that means stifling your creativity a bit. Many schools use the admissions essay to make sure students can understand and follow basic directions. If you’re asked to keep your essay under a certain word count, do it. An unfortunate number of applicants have been shocked to learn that admissions officers received only the f irst 500 words of their 1000-word essays. The applicants didn’t follow the instructions, and the admissions officers didn’t get the opportunity to read their brilliant concluding paragraphs. Let your personality shine through. One of the most common admissions office complaints is that college applications seem a little too staged. Admissions officials want to make sure that your application essay wasn’t written by your guidance counselor or a hired essay-writing service. Break away from the generic and share your lovable quirks. At the same time, remember that you don’t have to reveal everything. If a bit of your history casts you in a bad light, it’s better not to mention it.Emphasize your strengths. The application essay is the perfect opportunity for you to demonstrate your strengths and explain any blemishes on your record. Many colleges ask students to write a separate essay that explains what sets them apart from the crowd. If you have an assignment like that, don’t be shy. Describe your many talents in a confident, non-boastful manner. If you have blemishes on your academic record such as poor grades or an expulsion, now is the time to own up to these issues. Explain any extenuating circumstances (such as dropping out due to a family tragedy). If there is no good excuse, explain what you’ve learned from your mistakes and why you’ll never make them again. Even if you are not assigned an essay about your strengths, you can demonstrate your talents in just about any assignment. â€Å"Show† the reader what your strengths are by setting up a scene. For example: In an essay about a defining moment in your life, you may want to â€Å"show† the reader how you’ve demonstrated leadership under stress. Don’t brag about it; just set the scene. Edit your work. Once you’ve completed the application essay, let it set for a few days. Then, go back and edit your work. Taking a break will help you look at it with fresh eyes. Ask yourself: â€Å"Is there is anything I can change to make the essay more powerful?† Be sure to run spell check and analyze every sentence for grammatical mistakes. If your online school does not prohibit second party help, ask a former teacher or essay editing service for additional assistance. Writing a stellar college admissions essay takes time. By following these basic steps, you’ll be able to craft a piece to be proud of.

International Perspective on Environmental Health Assignment

International Perspective on Environmental Health - Assignment Example The major reason for the change in climate within the Vietnam is because of the activities increasing the emission of greenhouse gases. There are a lot of options for climate change mitigation for Vietnam. Reducing emissions of greenhouse gases below the current levels, or reducing the emissions in the current decade could offset the projected global emissions growth. The efficiency of distribution and supply could improve for better energy supplements. Similarly, using vehicles with cleaner diesel, fuel efficiency or hybrid vehicles could help promote transport solutions. Moreover, shifting the mode of transport from road to public and rail could also promote climate change mitigation (1). According to UNEP, the reduction of greenhouse gas emissions and air pollution by replacing fossil fuels with bio-fuels is of primary concern right now (2, p.543). According to the report by Pham, Vietnam has a large potential of agricultural and biomass by-products. An estimate of 53.45 million tons of agricultural by-products and 25.09 million tons of wood biomass has been recorded for Vietnam (3). According to the experts from the IMHEN (Institute of Meteorology, Hydrology and Environment) at the Ministry of Natural Resources and Environment claimed that the impact of climatic change can cause negative effects on the lives of the people and economy. The government of Vietnam was a keen participant in the United Nations Framework Convention on Climatic Change, which shows that the government is keen to make changes in the field of developing measures against the negative climatic changes. According to a lot of studies carried out, it has been revealed that Indonesia is at a great risk of the impacts that will be caused by the climatic changes. These revelations have been backed up by the Asian Development Bank (4), Dasgupta et. Al (5, p. 3-4) and Yusuf and Francisco (6). Indonesia plays an important role in the global mitigation actions because of its

Financial Motivation in University Students Research Proposal

Financial Motivation in University Students - Research Proposal Example One major factor that can be considered as the potential main motivation behind a student’s work rate is the goals that they wish to achieve in the future. For many youths, the concept of education making an individual a better and well-rounded person is not enough to keep their noses in the books when they have the chance to go out and do something that they find more entertaining and no-one to stop them. Therefore, when talking with regard to the future, material possessions and status can be considered more effective drives to make an individual study harder. However, other sources of motivation that do not relate to financial success should also be taken into consideration as the wealth is not the only factor to motivate individuals. For example, an individual who has been raised in a wealthy family with the assurance of financial security whether he succeeds in his quest for higher learning or not will be motivated by the thought of financial success as this is already av ailable to them. Other sources of motivation will be studied in such cases such as respect from their peers as well as pride; one may be motivated to excel in their education to prove that they are not dependent upon their family’s financial cushion and are able to make it in life without such assistance (Lara & Norton, 2009).The temptations that are present in the life of a university are many and the need for a strong motivation is a necessity should one want to succeed in overcoming them and going on to excel.

Polar Bear :: essays research papers

SPECIES- Ursus Maritimus, Polar Bear, lord of the Arctic. Lives in an area of five million square miles of snow and ice. From Siberia to Alaska and across Canada, Greenland and the Islands north of Norway, he is the master of all living things except man. It lives in the brutal cold, ice, and snow. The temperature can plunge down frequently to -40 degrees and sometimes even lower but that does not bother the polar bear because of its color-less skin and layer of insulation fat. Its range extending around the northern polar region. Necessities of Life-The polar bear eats mostly seals which he has to hunt. His trick is to wait by a breathing in the ice and when a seal comes up by that breathing hole, he grabs it so fast it knocks it unconscious and then he eats it. Other pray is a walrus calf or a musk ox stuck in snow, birds, eggs, fish, and dead whales. And sometimes in the summer it eats berries and grass. The polar bear has no water to drink so it only eats the skin and blubber, avoiding the meat. So by eating the blubber and leaving the meat the male bear is helping keep his body in balance with the surrounding environment. The bear would usually stay in a den or bury it self in the snow to avoid the suns ultra violent rays. Usually the pregnant female polar bear stays in the den.Food Chain-The polar bear finds its way on the top of its food chain. No predator on earth approaches the bear in size. The polar bear towers over everything else in his food chain. The only thing that could stop him is a human with a gun.Super Amazing Facts-The polar bear is well adapted to its special live style. The hairs of its thick coat are hollow, giving extra insulation against the bitter arctic cold. It also has an extra layer of insulating fat under its skin and the hairs on the polar bear are color less, when the sun hits them they look white. Polar bears are twice as big as lions or tigers, a typical adult male weighs half a ton and is five feet high at the shoulder. His paws are a fool wide. When he stands up straight, he can look an elephant in the eye.Explain- My species was endangered bad back in 1965 with no more than 5,000 left in the world.

Organization of the Police Department

Running a police department and preventing crime can be a complex task. Every individual within the police department including patrol officers, detectives, and clerical staff are vital in maintaining smooth order within the department and community. The organization of the police department is only effective when the officers know his or her roll and can fulfill the assigned duties based on the area, time, and purpose of the mission. The organization of the police department is what ensures an easy flowing and effective department. The organization does not just include the chain of command, but it includes how each officer will maintain order in the community by working different shifts and locations. Police officers can patrol the community in different areas known as beats or posts, zones, and precincts. A beat or post is generally a small area in which one or two officers can patrol by either squad car or on foot. The beat or post officers should be familiar with the people and businesses within the area, and also be aware of the risks and concerns in which officers may need to seek additional assistance. However, the beat or post area should be large enough to prevent boredom, but small enough to maintain with limited manpower (Dempsey & Frost, 2005). Next, a zone area within a community is when â€Å"a number of individual beats are grouped together† (Dempsey & Frost, 2005, p. 72). The purpose of zonal policing is to implement community policing, while providing a fast response time, performing visible patrols, and providing localized service to the community based on its needs (City of Windhoek, 2010). Finally, a precinct is an entire group of beats or posts in a specific area within a community. A precinct is used in larger communities with more officer manpower than a traditional small town. This keeps officers in assigned areas to ensure rapid response time and organization (Dempsey & Frost, 2005). Every police department across the world has to make good use of time and manpower to avoid stress and fatigue, and to ensure that more officers are on shift during the highest times of call volume. Police departments run on shifts that ensure that there are officers on duty 24-hours a day. Some departments may operate the three-tour system, whereas other departments may use fixed tours. The three-tour system uses three shifts a day that operates on either 8 or 12 hours per officer. Sometimes the shifts may overlap which can be used for additional manpower to patrol the community or used for training purposes. However, the numbers of officers may vary per shift due to the typical call volume every day. Some cities may experience a higher call volume at night; therefore, there is a need for a higher percentage of officers on the graveyard shift compared to the morning or afternoon shift. Additionally, the stress of the three-tour system can affect the personal life of the police officer and cause additional stress because the officer may work rotating shifts. Rotating shifts is when an officer may work all nights for an entire week, then the next week the officer may work the morning or afternoon shift to accommodate the three-tour system. The other type of shift, which is a fixed shift, is when officers are assigned to mornings, afternoons, or nights and usually maintain the same schedule. This option for the shift can be based on seniority; however, it does ensure that each officer gets adequate time for personal and social time (Dempsey & Frost, 2005). Another way to organize a police department is to place particular functions into separate groups to ensure a continuous flow throughout the department, as well as to prevent any confusion inside the department. The best way to keep the department organized is by grouping each job title together and keeping them separate from the rest. For instance, patrol officers should be grouped in the same unit, detectives should be grouped in another unit, and administration should be kept separate from these two groups. However, those are not the only groups within the department that should be kept separated. There are other positions such as juvenile, evidence, and communications that need to be secluded from other groups (City of Iowa City, Iowa, 2011). The purpose of each police department, however, is to ensure citizen safety by maintaining order within the community, enforcing state and local laws, as well as providing service to each member of the community (Dempsey & Frost, 2011). Although the tasks of the police department seem to be vast and complex, in reality each department is setup to provide organized service to the ommunity through careful planning of area, time, and purpose. Additionally, the way each police department is setup, it provides better service by ensuring that each area of the community is covered and that each officer has sufficient time to be relieved from duties for essential sleep, socializing, exercise, and family time. The planning and organizing of each department is as important as the protection and services that the department provides for each commun ity.

Running head: WHAT IS THE EFFECT OF LACK OF SLEEP ON A COLLEGE STUDENTS BRAIN AND BEHAVIOR Gilbert and Weaver (2010) examined the sleep quality with academic performance with university students, whether it is complete sleep deprivation or poor sleep quality. This study was to determine if lack of sleep or having poor sleep value in non-demoralized college students were related to the low academic routine. The authors expect to see more evidence showing that stress hormones are related with the relationship between sleeping and eating, which in other words, increases in stress lead to more snacking and a decrease in the consumption of typical meal-type foods (Oliver and Wardle, 1999). In their study they found that what they expected to find in the beginning had happened, in which there was a difference in food intake, measured by how much calories was consumed after the night of the students incomplete lack of sleep.
